Resumen de A transmutação da posse em propriedade na teoria possessória de Jhering

  This work aims to analyse, under a critical view, the possession theories of Friedrich Karl von Savigny and Rudolf von Jhering. Thus, it will be demonstrated that, behind the technical arguments of both romanists, there were different political and philosophical conceptions – by one side, aristocratic, classic and romantic at the same time, Savigny; by other side, bourgeois, Jhering.

  More than that, the method that the romanists used to reach their intentions will be analysed.

  Este trabalho tem por propósito analisar, sob um ponto de vista crítico, as teorias possessórias de Friedrich Karl von Savigny e Rudolf von Jhering. Demonstrar‑se‑á, assim, que, por detrás dos argumentos técnicos de cada um dos romanistas, repousavam concepções políticas e filosóficas distintas – de um lado, aristocrático, conservador, dialeticamente clássico e romântico, Savigny; de outro, burguês, liberal, Jhering.
