    El presente trabajo analiza la protección de la discapacidad en un ordenamiento multinivel. Partiendo de la actual configuración del ordenamiento jurídico donde confluyen normas que proceden de distintos centros con capacidad normativa, se ha abordado la protección de la discapacidad en el derecho internacional, el derecho de la Unión Europea, y el derecho interno. Igualmente hemos tenido la oportunidad de analizar la jurisprudencia tanto del Tribunal de Justicia de la Unión Europea como del Tribunal Constitucional, así como la doctrina del Consejo de Estado, concluyendo que la regulación de la discapacidad gira en torno a dos objetivos básicos, igualdad de oportunidades e inclusión. Y, finalmente, recogiendo alternativas de redacción para la reforma del art. 49 de la Constitución.

    The present work analyzes the protection of disability in a multilevel order. Based on the current configuration of the legal system where standards come from different centers with regulatory capacity, the protection of disability in international law, European Union law and domestic law has been addressed. We have also had the opportunity to analyze the jurisprudence of both the Court of Justice of the European Union and the Constitutional Court, as well as the doctrine of the State Council, concluding that the regulation of disability revolves around two basic objectives, equal opportunities and inclusion. And, finally, proposing a possible reform of the Constitution giving a new wording to art. 49 of the Spanish Constitution.
