La Ley Orgánica 6/2007, de 24 de mayo, efectuó una reforma integral de la Ley reguladora del Tribunal Constitucional (LOTC) y, en concreto, modificó sustancialmente el recurso de amparo constitucional. Pero, también, dio un nuevo contenido al incidente de nulidad de actuaciones recogido en el art. 241 de la Ley Orgánica del Poder Judicial (LOPJ). En principio, la modificación efectuada no incidía en la propia regulación de la LOTC, ni en las funciones del Tribunal Constitucional, sino solo en la LOPJ pero, tal y como vamos a analizar, el Tribunal Constitucional ha ido elaborando una jurisprudencia en la que analiza el alcance de dicha regulación: la debida actuación de jueces y magistrados ante su interposición; su relación con el recurso de casación y su debida y previa interposición al recurso de amparo, así como la relación entre los mismos.

Organic Law 6/2007, of May 24, modified the Organic Law of the Constitutional Court (LOTC) but, above all, Amparo (Appeal for constitutional protection of fundamental rights). But it also modified the incident of nullity of actions of article 241 of the Organic Law on the Judiciary (LOPJ). The modification of the incident of nullity of actions, in principle, did not affect the functions of the Constitutional Court, but the Judiciary. However, the Constitutional Court has drafted a jurisprudence on the regulation of the incident of nullity of actions, among other things: the performance of the judges; the relationship with the appeal and its relationship with Amparo.
