Se analizará el estado de la cuestión desde la óptica de distintas Audiencias Provinciales respecto al procedimiento previsto en el artículo 579 de la Ley de Enjuiciamiento Civil. Resoluciones que se han pronunciado no sólo sobre la posibilidad de que el ejecutado o fiadores hipotecarios puedan formular oposición a la ejecución. También sobre la declaración de abusividad de la cláusula de vencimiento anticipado. Siendo de sumo interés el alcance de dichas declaraciones. Conjugando la doctrina que al efecto ha establecido tanto el Tribunal de Justicia de la Unión Europea como el Tribunal Supremo. Las consecuencias de la retroactividad total alcanzarían al procedimiento hipotecario precedente, donde ya se haya realizado el inmueble pues supondría el sobreseimiento del mismo. De limitarse el alcance se ciñe al incoado con base a petición incardinada en el artículo 579 base de este estudio.
