The compatibility between the lease of a business unit and pre-bankruptcy arrangement with creditors is an issue on which there has been extensive debate over the recent years. The paper, after having briefly retraced the main questions debated, illustrates the current state of art in light of the recent Supreme Court’s jurisprudence, and then it examines the discipline introduced by the code of crisis and insolvency. The work concludes with an assessment of the remaining critical issues and those arising out of the new rules

La compatibilità tra affitto d’azienda e concordato preventivo costituisce un tema, sul quale vi è stato ampio dibattito in questi ultimi anni. Lo scritto, dopo avere ripercorso, sinteticamente, i principali profili oggetto di contrasto, illustra la situazione attuale alla luce della recente giurisprudenza di legittimità per poi prendere in esame la disciplina introdotta con il Codice della crisi e dell’insolvenza.
