Um panorama da legislação em favor dos recém-nascidos abandonados no império português ao longo da época moderna

    Buscaremos, neste presente artigo, levantar um breve panorama da legislação que orientou o fenômeno do abandono de recém-nascidos no Império português durante a época Moderna, mostrando que esse fenômeno por mais que estivesse presente desde a Antiguidade, foi somente a partir do século XV que as Ordenações Manuelinas criaram as primeiras leis que estabeleceram critérios para o acolhimento e o financiamento dos expostos, ao responsabilizarem legalmente as Câmaras pelo financiamento da criação deles até os sete anos.

    Ao longo de três séculos a dinâmica do abandono permaneceu sem grandes mudanças, e somente em meados do século XVIII perceberemos mudanças significativas nas leis de assistências aos enjeitados.

    This article was developed in order to treat a short perspective of the law that guide the newborn abandonment phenomenon in the Portuguese Empire during the Modern Age, showing that only in the beginning of the century XV, the Manueline Ordinatices created the first laws that determinate how should work the system of reception and gave to the Municipal Council the responsibility to finance the education of foundlings, although this phenomenon was present since Old Age. Along three centuries, the dynamic of abandonment keeping with no significant changes and only in the middle of the century XVIII major chances could be notable in the support’s laws to foundlings.
