O Direito Penal do Inimigo no Brasil – Uso da Necropolítica no Estado Pós-Democrático

    Objective of the study: Although the Democratic State of Law is in full force in Brazil, with some constitutional guarantees for the protection of those investigated and convicted, there are several violations of these guarantees by the State itself, when it comes to social control. This scientific work has the objective of verifying the violations by Brazil of the constitutional guarantees of protection when the occurrence of the necropolitics as a means of justifying “combating crime”.

    Methodology/approach: The method used was the hypothetical deductive, inductive, bibliographic and documentary research.

    Originality / Relevance: The originality of this research is in the relationship between the enemy's criminal law in Brazil and the use of necropolitics in the post-democratic state.

    Main results: The main results obtained with the triangulation of the data collected, is in the interpretation that the permission to use the enemy's criminal law and necropolitics does not fit with the Democratic Rule of Law and post-democracy.

    Theoretical contributions: The use of necropolitics in the post-democratic state of law is not allowed, due to the lack of coherence between the two.

    Objetivo do estudo: Ainda que no Brasil esteja em pleno vigor o Estado Democrático de Direito, com algumas garantias constitucionais de proteção dos investigados e condenados, tem-se diversas violações dessas garantias pelo próprio Estado, quando do controle social. Esse trabalho científico tem como objetivo constatar as violações pelo Brasil das garantias constitucionais de proteção quando ocorrência da necropolítica como meio de justificação de “combate ao crime”.

    Metodologia/Abordagem: O método utilizado foi o hipotético dedutivo, indutivo, da pesquisa bibliográfica e documental.

    Originalidade/Relevância: A originalidade dessa pesquisa está na relação do direito penal do inimigo no Brasil com o uso da necropolítica no Estado pós-democrático.

    Principais resultados: Os principais resultados apurados com a triangulação dos dados colhidos, está na interpretação de que não se coadunam com o Estado Democrático de Direito e com a pós-democracia, a permissão do uso do direito penal do inimigo e da necropolítica.

    Contribuições teóricas: Está não permissão do uso da necropolítica no Estado pós-democrático de direito, pela falta de coerência entre ambos.
