In this article the authors analyse the situation in Kazakhstan with respect to the need to adopt legislative GAARs. The authors discuss the current abusive practices in Kazakhstan, providing an assessment of the ability of existing anti-avoidance rules to combat these practices, and the draft policy recommendations on the nature of GAARs in Kazakhstan. The article takes into account the developing economy of the country and considers relevant examples in other jurisdictions.
In questo articolo gli autori analizzano la situazione in Kazakistan relativa alla necessità di adottare una GAAR di natura legislativa. Gli autori discutono delle pratiche abusive attualmente in uso in Kazakistan, fornendo una valutazione sulla capacità delle norme antielusive esistenti di contrastare tali pratiche, ed affrontano le raccomandazioni politiche sulla natura delle clausole generali anti-abuso in Kazakistan. L’articolo prende in considerazione lo sviluppo economico del Paese e considera rilevanti esempi forniti da altre giurisdizioni.
