La defensa de la Constitució com a relat i la crisi constitucional catalana

    Entre el 2010 i l’actualitat s’ha desenvolupat una profunda crisi constitucional a Catalunya, que culmina amb el referèndum de l’1 d’octubre de 2017, però que continua oberta. La tesi del present treball és que la resposta de les institucions centrals de l’Estat a les demandes d’una part de la societat catalana en relació amb el seu reconeixement polític han estat articulades entorn d’un marc de defensa de la Constitució. Aquesta interpretació de la situació respon a la hiperrigidesa estructural de la Constitució espanyola de 1978, així com a la progressiva eliminació de l’ambigüitat que permetia un encaix de posicions molt diverses en relació amb la construcció de la identitat nacional, que culmina amb la STC 30/2010. Aquest context explica una reacció basada en la defensa de la Constitució que, d’una banda, no permet trobar una solució deliberativa i consistent a la crisi, i, de l’altra, comporta costos notables des del punt de vista d’elements axiològics nuclears de la mateixa Constitució, com ara els drets de participació política o la divisió de poders.

    Between 2010 and the present, a deep constitutional crisis has developed in Catalonia, culminating in the referendum of October 1, 2017, but which remains open. The thesis of the present paper is that the response of the central institutions of the State to the demands of a part of the Catalan society in relation to its political recognition have been articulated around a framework of defense of the Constitution. This interpretation of the situation responds to the structural hyper-rigidity of the Spanish Constitution of 1978, as well as to the progressive elimination of the ambiguity that allowed to fit very diverse positions regarding the construction of the national identity, that culminates with the Decision of the Constitutional Court 30/2010. This context explains a reaction based on the defense of the Constitution that, on the one hand, does not allow to find a deliberative and consistent solution to the crisis, and, on the other hand, entails remarkable costs from the point of view of axiological core elements of the Constitution itself, such as the rights of political participation or the division of powers.
