Resumen de La crisis institucional de Venezuela: Algunos componentes de relevancia internacional

  Los acontecimientos recientes en que se ve envuelta la actividad institucional en Venezuela plantea algunas cuestiones de interés en el Derecho Internacional, entre los que sobresale el reconocimiento de gobiernos. Las irregularidades en los procesos electorales de elección del Presidente de la República y las graves alteraciones en el funcionamiento institucional en un sistema democrático han desembocado en la autoproclamación del Presidente de la Asamblea Nacional como representante legítimo de este Estado. El reconocimiento de este gobierno devuelve a la escena la institución del reconocimiento, que parecía en declive en la práctica internacional. El mantenimiento en el poder del Presidente electo de forma irregular suscita algunas consideraciones necesarias acerca de la efectividad del ejercicio del poder, así como de la eficacia del principio democrático en el ámbito interamericano y en el sistema de las Naciones Unidas.

  The Recent events involving institutional activity in Venezuela raise some questions of interest in international law, among which the recognition of governments stands out. The irregularities in the electoral processes for the election of the President of the Republic and the serious alterations in the institutional functioning in a democratic system have led to the self-proclamation of the President of the National Assembly as the legitimate representative of this State. The recognition of this government brings back to the scene the institution of recognition, which seemed to be in decline in international practice. The fact that the president-elect holds power in an irregular manner raises some necessary considerations about the effectiveness of the exercise of power, as well as the effectiveness of the democratic principle in the interAmerican sphere and in the United Nations system.
