Resumen de La crítica situación de los derechos sociales de la infancia, de las familias y de los emigrantes: Conclusiones 2019 del Comité Europeo de Derechos Sociales

El 24 de marzo de 2020 se publicaron las Conclusiones del Comité Europeo de Derechos Sociales correspondientes al año 2019/XXI-4, relativas al Grupo 4 de preceptos, que comprende los derechos de los menores, familia y migrantes. Se originan en uno de los dos mecanismos de supervisión, el sistema de informes, obligatorio para los Estados que han ratificado, total o parcialmente, la Carta Social Europea, en cualquiera de sus versiones, y el Protocolo adicional de 1988. El presente estudio tiene por finalidad examinarlas, mostrando los resultados generales de Europa y los particulares respecto a España, confrontarlos con los previos emitidos, para valorar un progreso o retroceso en la materia. El marco normativo regulador, así como el procedimiento son escasamente conocidos. Para solventar tal carencia, se ha procurado poner de relieve la repercusión de las Conclusiones dentro del ámbito jurídico considerado en su generalidad.

On March 24th, 2020, the Conclusions of the European Committee of Social Rights related to year 2019/XXI-4, regarding the provisions of the thematic Group 4, were published. Such Group 4 embraces children, families and migrants’ rights. The Conclusions were born in one of the two monitoring mechanisms, the reporting system, compulsory for the States which have entirely or partially ratified the European Social Charter, whether in its original or revised version and the additional Protocol of 1988. The aim of the present study is to examine the mentioned Conclusions, showing the general results from Europe and the individuals concerning Spain in comparison with the results previously issued, in order to evaluate the existence of a progress or a step backward in this field. Both the regulatory framework governing the field and its procedure are barely known. With the intention of dealing with this weakness, the present study is focused on emphasizing the impact of the Conclusions within the legal sphere generally considered.
