Los actos administrativos en virtud de los cuales se acuerda el cese de funcionarios en puestos de trabajo provistos por el sistema de libre designación constituyen el ejercicio de potestades administrativas discrecionales que precisan de motivación para su validez. La ausencia de motivación los convierte en actos arbitrarios. Procederá la anulación de tales actos cuando no se fundamenten en hechos objetivos relacionados con el mérito y la capacidad del funcionario que fueron tenidas en cuenta para su nombramiento, así como su idoneidad para el desempeño del puesto. La motivación debe permitir al funcionario cesado comprobar las razones del cese y defenderse de aquellos actos que les pudieran ser perjudiciales y que no se ajusten a derecho, lo que deberá poder ser apreciado por los correspondientes órganos judiciales.
