El naufragio del buque Costa Concordia el 13 de enero de 2012 provocó lesiones y la muerte de varios pasajeros. Una vez que han concluido los procesos civiles y penales cabe preguntarse si los legítimos intereses de los perjudicados se han visto satisfechos. En el presente trabajo analizamos los datos más relevantes del naufragio y, en particular, la sentencia del Tribunal Supremo, de 8 de abril de 2015, que reconoce a los pasajeros una indemnización por «daño moral» no vinculado a daños físicos o psíquicos, sin limitación económica y sin necesidad de acreditación.
The wreck of the Costa Concordia ship on fanuary 13, 2012 caused injuries and the death of several passengers. Once the civil and criminal proceedings have been concluded, it is appropriate to ask whether the legitimate interests of the injured parties have been satisfied. In this work we indicate the most relevant data of the shipwreck and, particularly, the Supreme Court ruling dated April 8, 2015, which recognizes monetary compensation to the passengers for «moral damage», not linked to physical ar psychological damage, without economic limitation and without the need for accreditation.
