El tercero perjudicado tiene derecho a reclamar directamente a la aseguradora la indemnización correspondiente por el daño que la ha causado el asegurado. Sin embargo, tal derecho no existe en el caso de que no se haya dado inicio a la cobertura propia del seguro, por impago de la primera prima imputable al tomador pues así lo establece la Ley de Contrato de Seguro, salvo pacto en contrario.
The injured third party has the right to claim directly from the insurer the corresponding compensation for the damage caused by the insured.
