El delito de maltrato de obra. Una reflexión sobre el ámbito de protección del art. 46 del código penal militar

    En este artículo se lleva a cabo una reflexión sobre cuál es el ámbito de protección del delito de maltrato de obra regulado en el art. 46 del CPM, para lo cual se realizará un examen tanto del bien jurídico protegido por el tipo atendiendo a su carácter pluriofensivo, como del propio concepto de maltrato de obra. Además, también se realiza una breve aproximación a la incidencia del abuso de autoridad en el ámbito militar y se examina brevemente la posibilidad de que conductas constitutivas de maltrato de obra puedan quedar justificadas. Por último, se lleva a cabo un breve comentario de la sentencia de la Sala 5ª de 4 de diciembre 2019.

    This article reflects on the military offence of ill-treatment of subordinate (article 46 of 2015 Military Criminal Law). Taking into consideration that article 46 is a multi-offensive crime, the article firstly approaches the offence legal right and then it turns to the concept of ill-treatment in the military field. It also provides an statistical overview of abuse of authority offences, and briefly examines whether ill-treatment could ever be justified. Lastly, a critical commentary on the 2019 Judgement of the Supreme Court (5th Chamber), 4 December, is also included.
