El nuevo estatuto jurídico de las víctimas del delito ante el sistema de justicia penal juvenil

    Pese a que en el derecho penal de menores haya de primar, como elemento determinante del procedimiento y de las medidas que en él se adopten, el superior interés del menor, la LO 5/2000, de 12 de enero, reguladora de la responsabilidad penal de los menores, tampoco olvida el interés propio de las víctimas o perjudicados en esta jurisdicción. Reconociéndoles un conjunto de derechos que serán analizados en este trabajo, los cuales se han visto reforzados tras las últimas reformas legislativas operadas en su texto original por la LO 15/2003 y LO 8/2006, y se habrán de interpretar ahora a la luz de lo establecido en el nuevo estatuto de la víctima del delito aprobado por la Ley 4/2015, de 27 de abril. Cuya aplicación a la jurisdicción penal juvenil, aunque con ciertas limitaciones como argumentaremos en nuestro estudio, consideramos que debe hacerse efectiva para ofrecer una adecuada respuesta a las necesidades de las víctimas que se vean obligadas a participar en ella.

    Although in the criminal law of minors, the best interest of the minor, LO 5/2000, of 12 January, regulating criminal responsibility, must prevail as a determining element of the procedure and the measures adopted therein of minors, neither does it forget the self-interest of the victims or the injured in this jurisdiction. Recognizing them a set of rights that will be analyzed in this work, which have been reinforced after the last legislative reforms operated in their original text by LO 15/2003 and LO 8/2006, and now they will have to be interpreted in light of the provisions of the new statute of the victim of the crime approved by Law 4/2015, of April 27. Whose application to juvenile criminal jurisdiction, although with certain limitations as we will argue in our study, we consider that it must be effective to offer an adequate response to the needs of victims who are forced to participate in it.
