Resumen de La asignatura de Religión católica y su anclaje en la escuela pública (estudio jurisprudencial)

Una vez más, con un nuevo gobierno se prepara una nueva ley de educación que, entre sus miras y de forma artificial e interesada, contempla una vuelta de tuerca a la sempiterna asignatura de Religión. En el presente trabajo se presenta un pequeño esbozo de la normativa internacional y se plantea el origen de la asignatura en la legislación patria y democrática, su carácter voluntario y su asignatura espejo. También se aborda y se señala como incongruente que la asignatura de Religión no compute a efectos académicos, siendo extraña para las becas y las ayudas al estudio personalizadas o el acceso a la universidad. Finalmente se reflexiona sobre el manido e indeterminado concepto que tiene la asignatura de Religión en el Acuerdo internacional en materia de Enseñanza y Asuntos Culturales entre el Estado español y la Santa Sede, esto es, el de condiciones equiparables a las demás disciplinas fundamentales.

Once again, with a new government a new education law is prepared that, among its sights and in an artificial and interested way, contemplates a twist to the eternal subject of Religion. This paper presents a small outline of the international regulations and outlines the origin of the subject in the national and democratic legislation, its voluntary nature and its mirror subject. It is also tackled and pointed out as illogical that, in the proposed bill, the subject of Religion does not compute for academic purposes, being strange for scholarships and personalized study aids or access to university. It also reflects on the hackneyed and indeterminate concept of the subject of Religion in the International Agreement between the Spanish State and the Holy See on Teaching and Cultural Affairs, that is, the conditions comparable to the other fundamental disciplines.
