Resumen de El resurgimiento del registro de entidades religiosas

El presente trabajo realiza un análisis revisionista de la doctrina del Tribunal Supremo y de la Audiencia Nacional que, al albur de la Sentencia del Tribunal Constitucional 46/2001, ha sido considerada sostenedora del criterio contrario a la existencia de una potestad calificadora de la Administración en su cometido al frente del Registro de Entidades Religiosas.
Este estudio se hace con ocasión de varias decisiones del Ministerio de Justicia (denegando la inscripción a entidades tales como las denominadas ‘Iglesia Pastafari’ y ‘Colegueo de los infieles a Crom’) y la Sentencia de la Audiencia Nacional de 1 de octubre de 2019, relativa a esta última entidad.
Debe llegarse a la conclusión de que sólo un cúmulo de contrasentidos, judiciales y administrativos, ha dado lugar a negar una potestad del Ministerio de Justicia que, sin embargo, siempre ha tenido, como es la facultad de calificación de tipo registral.

his paper makes a revisionist analysis of the judicial doctrine of the Spanish Supreme Court and of the Spanish National Court which, to the whim of the judgment of the Spanish Constitutional Court 46/2001, has been considered supportive of the opposite criterion to the existence of the Ministry of Justice‘s qualifying power when performing its functions as the head of the Registry of Religious Entities.
This study is motivated by several decisions of the Ministry of Justice (rejecting the registration of some religious entities such as the so-called ‘Iglesia Pastafari’ and ‘Colegueo de los infieles a Crom’) and the judgment of the Spanish National Court of 1 October 2019 referred to the religious entity last mentioned case law.
It must be concluded that only an accumulation of judicial and administrative contradictions, has led to the denial of one of the Ministry of Justice’s competences which, however, has always had, as it is the power to determine registry qualification.
