Repensar el trabajo migrante desde el principio de justicia social

    En el presente trabajo, se comienza haciendo una breve consideración del derecho a la libre circulación de personas, para dar pie luego a un análisis jurídico particular del trabajo migrante, especie de aquel fenómeno más general. En ese marco, nutriendo los contenidos normativos enunciados con aportes filosóficos, tratamos de vincular el punto del trabajo migrante, con el principio de justicia social, y con un estudio constitucional consecuente. Aunando lo anterior con contenidos de la Declaración Socio Laboral de Mercosur, cerramos el círculo con aportes provenientes de la sociología y la política, lo que nos permite comprender finalmente que el fenómeno migratorio no es un hecho social pasado, sino actual en nuestra realidad social e institucional (aun considerando las variaciones ocurridas en las últimas décadas), y la importancia que para nuestras instituciones democráticas, tiene la idea de sumar aportes que tiendan a constituir una sociedad más igualitaria y justa.

    In this paper, I begin by making a brief consideration of migration and the freedom of movement. I then move to a particular legal analysis of migrant work. In this context, by nourishing the normative contents enunciated with philosophical contributions, we try to link the point of migrant labor, with the principle of social justice, and with a consequent constitutional study. Adding to those aspects the Mercosur Socio-Labor Declaration, we close the circle with contributions from sociology and politics, which allows us to finally understand that the migratory phenomenon is not a past social fact, but actual in our social and institutional reality (even considering the variations that have occurred in the last decades), and the importance that this contribution to a more egalitarian and just society may have to our Democracy.
