Resumen de Argumentação jurídica e legitimidade democrática da Jurisdição Constitucional

El presente artículo defiende que el debate teórico sobre la legitimidad democrática de la justicia constitucional también debe ser enfocado en la perspectiva empírica de la práctica de decisión de los Tribunales Constitucionales. Después de (1) explicar cómo la reciente difusión de la judicial review en el mundo exigió nuevas reflexiones teóricas sobre las relaciones entre jurisdicción constitucional y democracia, el artículo defiende (2) un abordaje centrado en las prácticas argumentativas de los Tribunales Constitucionales para, al final, presentar (3) el contexto institucional ibero y latinoamericano como un “laboratorio constitucional” adecuado para realizar ese tipo de investigación.

The article argues that the theoretical debate on the democratic legitimacy of judicial review must also be focused on the empirical perspective of the decisión-making practice of the Constitutional Courts. After (1) explaining how the recent diffusion of judicial review in the world demanded new theoretical reflections on the relations between constitutional jurisdiction and democracy, the article defends (2) an approach centered on the argumentative practices of the Constitutional Courts. In conclusion, the text presents (3) the Iberian and Latin American institutional context as a suitable “constitutional laboratory” for this type of research.
