    The crime of disobedience has as an objective requirement the imposition of a duty to act and the consequent creation of a personal obligation. In principle, a command issued by a judicial decision generates a duty to act, which conforms to the objective type, making up the corresponding typical elementary ones. However, in view of the constitutional competence of the notarial activity, a complex issue is related to the creation of the legal duty to register, by those who have the duty to legally qualify the title object of the registration, namely the real estate registrar. This issue and its variables are the object of this investigation.

    O crime de desobediência tem como requisito do tipo objetivo a imposição de um dever de agir e a consequente criação de uma obrigação personalíssima. Em princípio, um comando emanado por uma decisão judicial gera um dever de agir, que se amolda ao tipo objetivo, perfazendo aquelas elementares típicas correspondentes. Entretanto, em face da competência constitucional da atividade notarial, é questão complexa a referente à criação do dever jurídico de registrar, por parte de quem possui o múnus de qualificar juridicamente o título objeto do registro, nomeadamente o registrador imobiliário. O enfrentamento dessa questão e de suas variáveis é o objeto da presente investigação.
