Resumen de Allocating scarce medical resources under German Criminal Law: the justifying collision of duties in triage situations

How should a doctor decide who faces two critically ill patients but only one rescuing ventilator? Not only in Germany the problem of allocating scarce medical goods and services, known as “triage”, was raised anew during the Covid-19 pandemic. In such situations, decision-makers not only face severe psychological stress, but also bear the risk of criminal liability. This article deals with the latter from the perspective of German criminal law. It points out the decision-making and action options available for medical staff in triage situations without running the risk of criminal liability. After an introduction to the different triage situations, triage will be located within the framework of criminal law dogmatics. It will be shown that medical staff, when carrying out triage in a permissible manner, acts within the framework of the legal concept of the justifying collision of duties and therefore is not acting unlawfully. Afterwards, the criteria for the allocation of scarce medical goods in the different triage situations are discussed. It will be shown, which criteria must be mandatory applied, and which seem preferable for other reasons, albeit their application is not mandatory under criminal law. The article concludes with a summary of the results found.

Como deve decidir um médico diante de dois pacientes em situação crítica e dispondo de um único ventilador pulmonar? O problema envolvendo a alocação de recursos médicos escassos, presente não apenas na Alemanha e conhecido como “triagem”, foi novamente suscitado em decorrência da pandemia de Covid-19. Em tais casos, quem toma as decisões enfrenta, além do severo estresse, o risco de ser responsabilizados penalmente. O presente artigo lida com essa questão a partir da perspectiva jurídico-penal alemã mediante revisão bibliográfica a análise de precedentes, apresentando as opções disponíveis para as tomadas de decisão e ações disponíveis para equipes médicas sem violar a lei penal. Após introduzir diferentes situações de triagem, estas serão tratadas conforme a dogmática jurídico-penal. Será demonstrado que as equipes médicas, ao realizem a triagem de maneira admissível, agem conforme o conceito da causa de justificação denominada colisão de deveres e, portanto, não incorrem em uma prática ilícita. Ato contínuo, serão discutidos os critérios para a alocação dos recursos escassos, apresentando quais são obrigatórios segundo o direito penal e quais são preferíveis por outras razões. As conclusões reúnem as soluções encontradas para os casos tratados.
