The authors aim to describe and analyze the decisions made by the Superior Court of Justice of Brazil in the judgment of AgRg-REsp 1730341, regarding the retroactive application of art. 215-A, which was included in the Brazilian Penal Code by Law nº 13.718/2018 and which established the crime of sexual battery. The authors list the general conditions necessary to the retroactive application of a norm establishing a new crime and conclude they were absent in the given case. Finally, the authors analyze the Court’s statement that the facts under trial could be deemed as rape under art. 213 of the Penal Code, and disagree with it.
O artigo descreve e analisa as decisões proferidas pelo Superior Tribunal de Justiça no julgamento do AgRg-REsp 1730341, relativas à aplicação retroativa do art. 215-A, incluído no Código Penal pela Lei nº 13.718/2018, e que institui o crime de importunação sexual. No texto, fixam-se as condições gerais para a aplicação retroativa de uma norma que institui um novo crime e verifica-se se elas estavam presentes no caso concreto, concluindo-se pela resposta negativa. Por fim, analisa-se a afirmação, pelo STJ, de que o fato levado a julgamento preenchia os requisitos legais do crime de estupro, previsto no art. 213 do Código Penal, concluindo-se também negativamente.
