Los retos de la regulación de la voz sobre el protocolo IP

    La VoIP – en inglés Voice over Internet Protocol -está experimentando actualmente un increíble crecimiento y en los años por venir serán docenas de miles de operadores ofreciendo lo que sólo pocos ofrecen hoy. El ambiente regulatorio por el momento es estable, pero no por mucho tiempo. La combinación entre incertidumbre y crecimiento es potencialmente peligrosa y la postura del regulador debe establecerse ahora, mientras la industria es pequeña. Por ello se requiere remover del lenguaje regulatorio las viejas ideas relativas a la tecnología y repensar qué pasará con las cargas regulatorias y con las reglas relativas a las obligaciones legales, entre otros aspectos. Es adecuado regular los poderes monopólicos pero no las comunicaciones de datos en sí mismas consideradas. Entonces, tendremos que ver lo que traerá la regulación futura. Actualmente, los operadores están demandado una mayor regulación por cuanto la VoIP cambia las reglas del juego, particularmente, respecto a cómo la voz es proveída. Tendrán que establecerse, en consecuencia, condiciones regulatorias; de lo contrario las compañías telefónicas tradicionales van a perder cientos de millones de dólares.

    VoIP - Voice over Internet Protocol - is undergoing incredible growth right now, and in the next years there will be dozens of operators offering what only a few offer today. The regulatory environment is stable at the moment, but far from certain. The combination of uncertainty and growth is potentially dangerous, and regulatory stances need to be established now while the industry is still small. There is a need to remove from regulatory wording, old ideas of technology and to rethink needs like regulation charges and what could happen with the application of legal obligations. It is adequate to regulate the monopolistic powers, not the data communications on it. Then we shall see what the future regulation brings.

    Actually, carriers are pushing regulation because VoIP changes the game in terms of how voice services are delivered. Regulations have to be instituted, because if they are not, phone companies will to lose hundreds of millions of dollars.
