    This article intends to analyze the immediacy and the orality in the criminal procedure, questioning the importance and consequences of such elements for the criminal justice structure. For this purpose, the basis of orality and the grounds of immediacy will be analyzed. It is thought, however, that none of its current justifications can be accepted. Therefore, the problems that will guide this paper are: 1) What is the importance of orality to criminal justice?; 2) What is the basis of immediacy in criminal proceedings? Therefore, in addition to emphasizing the indispensability of orality for criminal procedure, a new basis will be proposed for the immediacy, as the presence and influence of the parties in the oral hearing and in the decision-making process, imposing the direct contact of the judge with the parties and with the evidence to ensure that the judge has taken cognizance of all the elements that should guide his decision-making process.

    Este artigo pretende analisar a imediação e a oralidade no processo penal, questionando a importância e as consequências de tais elementos para a estruturação da justiça criminal. Para tanto, analisar-se-á o embasamento da oralidade e as fundamentações da imediação. Pensa-se, entretanto, que nenhuma das justificações atuais pode ser aceita. Portanto, os problemas que guiarão este trabalho são: 1) Qual é a importância da oralidade para a justiça criminal?; 2) O que é e qual é o fundamento da imediação no processo penal? Diante disso, além de se ressaltar a indispensabilidade da oralidade para a dogmática processual penal, será proposto novo conteúdo para a imediação como a necessidade de presença e influência das partes no desenrolar do processo e na tomada da decisão judicial, impondo o contato direto do juiz com as partes e com as provas para assegurar que o julgador tomou conhecimento de todos os elementos que devem guiar o seu ato decisório.
