La persistente crisis de los refugiados en Europa. El marco jurídico y de gestión de la Unión Europea

    Aunque el período más grave de la crisis de refugiados en Europa fue sin duda el año 2015, este persistente conflicto sigue sin solución, como siguen sin resolverse las causas y los factores que lo condicionan. En este tiempo, ha quedado demostrado que las estructuras de gobernanza del sistema internacional no tienen capacidad para responder adecuadamente a los nuevos desafíos. El fenómeno de las migraciones forzadas es una clara expresión de la complejidad de los escenarios internacionales actuales. La crisis de refugiados, o crisis migratoria como también es denominada, ha puesto, y sigue poniendo, a prueba los fundamentos de la Unión Europea, que atraviesa, además, una auténtica crisis existencial. En este artículo se analizan, por un lado, la situación, el contexto y las condiciones de los migrantes forzados y más particularmente de los refugiados, y, por otro, el papel que la Unión Europea está desarrollando frente a esta crisis, cuando está atravesando graves dificultades. Se analizan además los instrumentos jurídicos y de gestión de los que dispone la Unión Europea para enfrentarse a estas crisis.

    Although the most serious period of the refugee crisis in Europe was undoubtedly the year 2015, this persistent conflict remains unresolved, as the causes and factors that condition it remain unresolved. At this time, it has been demonstrated that the governance structures of the international system do not have the capacity to respond adequately to the new challenges. The phenomenon of forced migration is a clear expression of the complexity of today’s international scenarios. The refugee crisis, or migration crisis as it is also called, has tested, and continues to test, the foundations of the European Union, which is also going through a real existential crisis. This article analyzes, on the one hand, the situation, context and conditions of forced migrants and more particularly of refugees, and, on the other, the role that the European Union is developing in the face of this crisis, when it is going through serious difficulties. The legal and management instruments available to the European Union to face these crises are also analyzed.
