The present paper seeks to synthesize the case law doctrine established by the First Chamber of the Tribunal Supremo (Supreme Court) regarding the defects that may imply an infraction of the procedural rules regulating the judgement. This, as the final decisive resolution of the lawsuit, has to respond to a logical and argued process in which the legal debate raised is answered. However, this is not always the case, and the procedural misstatement of the judgement can, in certain cases, open the way to the outlawed defencelessness.
