Resumen de Hidro-diplomacia y soberanía nacional en el acuífero guaraní: ¿fracaso de un intento de gestión transfronteriza por intereses geopolíticos divergentes?

El Sistema Acuífero Guaraní es una masa de agua subterránea que se comparte entre Brasil, Argentina, Paraguay y Uruguay. Representa una importante fuente de agua potable renovable. El desarrollo económico, el crecimiento de la población y la exacerbación de la contaminación están ejerciendo presión sobre el acuífero. En respuesta a estos problemas, los cuatro gobiernos interesados han intentado desarrollar un marco legal e institucional adecuado para garantizar una gestión eficaz y sostenible. Las cuatro partes firmaron el Acuerdo del Acuífero Guaraní el 2 de agosto de 2010. Nueve años después de la firma del tratado, éste ha resultado en un simple esqueleto legal, al no haber dado lugar a un verdadero foro de cooperación. Este artículo analiza las herramientas institucionales y legales disponibles para las partes, así como los intereses geopolíticos que han impedido el establecimiento de una gestión integrada, sostenible y eficiente de las aguas del Sistema Acuífero Guaraní.

The Guarani Aquifer System is a body of groundwater shared by Brazil, Argentina, Paraguay and Uruguay. It represents an important source of renewable drinking water. Economic development, population growth and exacerbation of pollution are putting pressure on the aquifer. In response to these problems, the four governments concerned have sought to develop an appropriate legal and institutional framework to ensure effective and sustainable management. The four parties signed the Guarani Aquifer Agreement on 2 August 2010. Nine years after the signing of the treaty, it has resulted in a simple legal skeleton, as it has not given rise to a real forum for cooperation. This article analyzes the institutional and legal tools available to the parties, as well as the geopolitical interests that have prevented the establishment of an integrated, sustainable and efficient management of the waters of the Guarani Aquifer System.
