El presente trabajo se propone contribuir a la mejor comprensión del instituto del despido y sus consecuencias jurídicas patrimoniales y extrapatrimoniales, a partir de una breve comparación entre el sistema jurídico argentino y español. Para ello, se realizará un análisis jurídico de legislación, jurisprudencia y doctrina argentina y española, tendiente a evidenciar la necesidad de dar efectiva tutela a derechos y garantías consagradas por las Constituciones Nacionales y el derecho internacional de los derechos humanos

This work is intended to contribute to a better understanding of the dismissal and its patrimonial and extra-patrimonial legal consequences from a brief comparison between the Argentine and Spanish legal system and from the analysis of the constitutional protection of the right to work as the boundary to dismissal. In order to achieve this, a legal analysis of legislation, jurisprudence and Argentina and Spanish doctrine will be carried out, aimed to demonstrate the need for effective protection to rights and guarantees enshrined in national constitutions and international law of human rights.
