L'Europe: un havre de protection contre les abus des entreprises multinationales a l'étranger?: considérations de droit international privé

    • Over the past years, several scandals have revealed labour and environmental abuses committed by certain transnational companies taking advantage of the weak governance systems of the developing countries where they established some of their production activities. Victims of business-related human rights abuses have increasingly been seeking remedies in the domestic legal systems where the parent companies are headquartered. Therefore, many claims have been presented before european jurisdictions. This article studies european private international law rules and instruments to determine their efficiency in guaranteeing access to justice to victims of corporate wrongs committed in non-european countries. This article also discusses ideas of reforms to extend european courts' jurisdiction over such matters and to facilitate victims' access to european national courts.
