    The originating Constituent Power, in Brazilian Constitution of 1988, listed the individual and collective rights, including the right of practicing sports, which is in the article 217. However, our main source for analysis when we study the Sports Soccer Law in Brazil is undoubtedly the law n° 9615/18, better known as “Pelé Law”. Despite this legislation regulating all the sports disciplines, it has engaged the creation of many legal institutions of Sports Law related to soccer. As an example, the replacement of the club contract for the penalty clause and the subspecies of athletes. Likewise, it was by the influence of the effects of Pelé Law in Brazilian legal order that global soccer organizational culture had suffered a great change, which is, therefore, a turning point in soccer’s history. In this scene, our research object will be the repercussion of club pass extinction and the impacts caused towards club entities and athletes under the perspective of the relation of soccer player with the club entity that is going to be regulated by the civil order contract and not the labor law.

    O poder constituinte originário, na Carta Magna brasileira de 1988, elencou um rol de direitos individuais e coletivos, entre os quais, o direito à prática esportiva, que está presente no artigo 217. Entretanto, a principal fonte de análise quando estudamos o Direito Desportivo Futebolístico no Brasil é, sem dúvida, a Lei nº 9.615/98, mais conhecida como Lei Pelé. Apesar desta legislação regulamentar todas as modalidades desportivas, foi, por seu intermédio, que se inovaram diversos institutos jurídicos do Direito Desportivo relacionados ao futebol, como, por exemplo, a substituição do passe pela cláusula penal e as subespécies de atletas; bem como foi por influência dos efeitos da Lei Pelé no ordenamento jurídico brasileiro que houve uma forte mudança na cultura organizacional futebolística global, o que constitui, portanto, um divisor de águas da história do futebol. Neste cenário, o objeto de nossa pesquisa serão os reflexos da extinção do passe e os impactos causados às entidades clubistas e aos atletas sob a perspectiva da relação do atleta jogador de futebol com a entidade clubista a ser regulada por meio do contrato de ordem civilista e não trabalhista.
