    El impulso comunitario para la incorporación a los ordenamientos nacionales del recurso especial obligó a regular esta figura caracterizada por ser un método rápido y eficaz con el que poder impugnarse decisiones que violen el Derecho comunitario en materia de contratos públicos.

    El recurso especial es hoy una figura con la finalidad de tutela al licitador y de control a la Administración en materia de contratación pública. Recurso con un aspecto subjetivo relativo a su legitimación que garantizan la seguridad jurídica y reducen la litigiosidad en sede de la jurisdicción contencioso-administrativa sobre este sector contractual.

    La dimensión subjetiva del recurso especial, la legitimación, encuentra su clave en la extensión del interés legítimo en cuanto posición de ventaja o de utilidad jurídica para obtener un beneficio o una evitación de un perjuicio ciertos y no meramente hipotéticos

    The community impulse for the incorporation into the national ordinance of the special resource forced to regulate this figure characterized by being fast and effective method with which to be able to challenge decisions that violate Community law in the matter of public contracts.

    The special resource is today a figure with the purpose of guardianship of the tenderer and control of the Administration regarding public procurement. Appeal with a subjective aspect related to its legitimacy that guarantee legal certainty and reduce litigation at the seat of the contentious-administrative jurisdiction over this contractual sector.

    The subjective dimension of the special resource, the legitimation, finds its key in the extension of the legitimate interest in a position of advantage or legal utility to obtain a benefit or avoidance of a certain and not merely hypothetical damage
