El texto tiene por objetivo principal sistematizar y analizar los principales instrumentos jurídicos realizados desde el derecho internacional para proteger a los migrantes. Está precedido por una sección en la que se presentan datos teóricos en relación con la migración en general y se señalan las principales características, funciones y proceso de creación de la institución internacional de protección a los refugiados. Posteriormente se analizan los instrumentos jurídicos principales internacionales que protegen a los refugiados: la Declaración Universal de los Derechos Humanos, el Estatuto de la Oficina del Alto Comisionado de las Naciones Unidas para los Refugiados, la Convención de 1951 y el Protocolo de 1967 sobre el Estatuto de los Refugiados. En el siguiente apartado se discute la manera en la que desde la doctrina y el derecho ha sido tratado el asilo en Latinoamérica. En el último apartado se advierte la poca protección que desde el Derecho internacional han tenido los migrantes económicos y se analiza el instrumento jurídico más relevante realizado en la materia: la Convención internacional sobre la protección de los derechos de todos los trabajadores migratorios y sus familiares.

The main objective of this text is to systematize and analyze the main legislation realized within the framework of international law in order to protect immigrants. The text is preceded by a section in which we present theoretical data with respect to immigration in general, and we point out the main characteristics, functions and process of creation of the international institution of protection to refugees. Subsequently, we analyze the main international legislation that protect the refugees. The Universal Declaration of Human Rights, the Estatute of the Offi ce of the United Nations High Commissioner for Refugees), the 1951 Convention and 1967 Protocol relating to the Status or Refugees. In the next section, we discuss the way in which asylum has been dealt with within the framework of doctrine and law. In the last section, we talk about the little protection that economic immigrants have had within the framework of international law, and we analyze the most important legislation law realized in this matter: The International Convention of the Protection of the Rights of All Migrant Workers and Members of Their Families.
