Resumen de A educação como política de integração local de crianças refugiadas: uma análise sobre sua efetividade no Estado Espanhol

Refugee law is one of the great challenges of the 21st century, in view of the fact that different countries have experienced a large influx of forced migration, including Spain on the European, country that in the last decades have received a large number of asylum seekers/refugee, including children, which, according to the definition of the Convention on the Rights of the Child, 1989, are individuals under the age of eighteen. To address the refuge, the United Nations High Commissioner for Refugees has created some lasting solutions for those in refugee situations, including local integration. Among the local integration policies, one of the main ones is education, human and fundamental right embodied in international treaties and country laws of different countries. However, despite the fact that the international protection documents deal with this vulnerable group, both in terms of age, refuge, and education, Brazilian and Spanish doctrines are still incipient regarding the approach of children in situations of refuge and their inclusion to the host society, as a way to enjoy the inherent rights of the human person, which is why the choice of theme.

O direito dos refugiados representa um dos grandes desafios do século XXI, tendo em vista que distintos países vêm experimentado um grande fluxo de migração forçada, incluindo a Espanha, no continente europeu, país que na última década tem recebido um grande número de requerentes de asilo/refúgio, incluindo crianças, que de acordo com definição da Convenção sobre os Direitos da Criança, de 1989, são os indivíduos com menos de dezoito anos. Para tratar o refúgio, o Alto Comissariado das Nações Unidas para os Refugiados criou algumas soluções duradouras para aqueles que se encontram em situação de refúgio, dentre as quais está a integração local. Entre as políticas de integração local, uma das principais é a educação, direito humano e fundamental consubstanciado em tratados internacionais e legislações pátrias de distintos países. Mas, apesar dos documentos de proteção internacional tratarem desse grupo vulnerável, tanto no que tange a faixa etária, quanto ao refúgio, e ao campo da educação, a doutrina espanhola ainda é incipiente quanto a abordagem das crianças refugiadas e sua inclusão à sociedade de acolhimento como forma de fruírem direitos inerentes à pessoa humana, razão pela qual a escolha do tema.
