En el Derecho español, el Derecho iberoamericano y la Jurisprudencia Internacional, la acción popular popular está de actualidad. En los últimos años se ha abierto en España un debate doctrinal y político sobre la conveniencia de reformar el régimen jurídico de la acción popular, mediante una mejor delimitación de su objeto y finalidad. La cuestión de la legitimación procesal popular y su papel en la Administración de Justicia es, por otra parte, un tema central en la concepción del Estado, especialmente planteado en determinadas etapas históricas, como la romana, al afectar a instituciones básicas como la Administración de Justicia, la tradición democrática, la interrelación entre derecho público y derecho privado, y el interés general.

In Spanish Law, Latin American Law and International Jurisprudence, popular action is a current issue. In the last years a doctrinal and political discussion has been opened in Spain about the convenience of reforming the juridical regime of the popular action, through a better delimitation of its object and aim. The question of popular procedural legitimization and its role in the Administration of Justice is, on the other hand, a central issue in the conception of the State, especially raised in certain historical stages, such as the Roman one, as it affects basic institutions such as the Administration of Justice, the democratic tradition, the interrelationship between public law and private Law, and the general interest.
