    L’A. esamina due frammenti - Ner. D.19.1.31.2 e Ulp. D.6.2.9.4 - nei quali si affronta il problema dell’individuazione del compratore da tutelare, con prevalenza sull’altro, fra coloro che hanno comprato dal medesimo venditore o da due venditori non proprietari. Si sofferma, in particolare, sul caso della compera da due venditori, perché con riferimento ad esso emerge l’esistenza di una diversità di opinioni tra i giuristi, variamente spiegata dagli studiosi.

    L’A. offre un contributo volto a chiarire, ancor di più di quanto si è fatto, i termini reali di questa diversità di opinioni.

    Two fragments - Ner. D.19.1.31.2 e Ulp. D.6.2.9.4 - deal with the problem which one between two buyers deserves protection. In one case, the two have bought from the same seller; in the other one from two non domini-sellers. In his general treatment the author examines in particular the latter case because with regard to this fragment there are different opinions among the jurists differently treated by the scholars. The author has an explanation for such divergences in the Roman jurisprudence and let the doctrine take a step forward on the status quaestionis so far.
