    La Novella 15, promulgada por el emperador Justiniano I en 535, constituye uno de los principales elementos legislativos para abordar la reformulación del cargo de defensor civitatis, instituto revitalizado durante dicho periodo y de capital importancia por lo que respecta a la reordenación municipal desarrollada por el emperador bizantino. Al mismo tiempo, la citada disposición es un instrumento de utilidad para definir ciertos problemas que aquejaban a la institución, como la intervención indebida por parte de los gobernadores provinciales en el acceso al cargo, así como el alcance de las reformas propuestas por Justiniano, a la vez que hace posible profundizar en la cuestión del supuesto uso clasicista de la terminología y los conceptos propios de la administración municipal en la legislación justinianea.

    The Novella 15, enacted by the emperor Justinian I in 535, can be considered as one of the key legislative instruments regarding the reshaping of the defensor civitatis. The imperial administration intended to revitalize the institution and established it as a cardinal element in the reforms of the local administration conducted during the reign of Justinian. Simultaneously, the provision is a useful component in order to define some of the problems faced by the office, such as the improper intervention by the provincial governors in the access to the position. The analysis of the Novella will also be of interest to determine the scope of the reforms in the local administration carried out by Justinian and the alleged ‘classicist’ use of the terms and concepts related to the local administration in the Corpus Iuris Civilis.
