La Corte Constitucional en la Sentencia T-027 de 2019, atendiendo a la asimetría de condiciones entre las partes de un contrato de seguro, impone unas cargas adicionales a las compañías de seguros, modificando la jurisprudencia que hasta el momento se venía utilizando. Esta modificación gira entorno a la buena fe en el contrato de seguro, la cual se concebía como una ubérrima buena fe. Este elemento esencial del contrato de seguro, les permitía a las aseguradoras creer en la palabra del tomador al declarar el estado del riesgo, no obstante, esta sentencia afirma que ante la reticencia o inexactitud en la formación del contrato no se genera, en principio, la nulidad relativa o anulabilidad del contrato. Puesto que, ante las declaraciones del tomador, la compañía de seguros debería ejecutar una serie de actuaciones para confirmar lo dicho por el tomador, ignorando su declaración y buena fe. En este sentido, lo que anteriormente se entendía por creer en la buena fe, hoy sería personificar la negligencia.
The Constitutional Court in Sentence T-027 of 2019, taking into account the asymmetry of conditions between the parties to an insurance contract, imposes additional burdens on insurance companies, modifying the jurisprudence that had been used up until now.
This modification revolves around good faith in the insurance contract, which was conceived as a bountiful good faith. This essential element of the insurance contract allowed insurers to believe in the words of the policyholder when declaring the state of the risk, however, this ruling states that due to the reluctance or inaccuracy in the formation of the contract is not generated, in principle, the relative invalidity or nullity of the contract. Since, before the statements of the policyholder, the insurance company should execute a series of actions to confirm what was said by the policyholder, ignoring his statement and good faith. In this sense, what was previously understood by believing in good faith, today would personify negligence.
