Resumen de La responsabilidad de mando aplicada al modelo de justicia transicional del acuerdo final para la terminación del conflicto

El presente trabajo busca desarrollar el concepto de responsabilidad de mando o de superior en el ordenamiento jurídico colombiano, la forma como ha sido aplicado jurisprudencialmente nacional e internacionalmente. De allí que esta figura sea tomada como uno de los principales elementos de cualquier proceso de justicia transicional, precisamente por la necesidad de establecer qué va a pasar con los jefes militares responsables de delitos durante un conflicto.
Con base en lo anterior, se verificará si los desarrollos normativos para la aplicación del acuerdo final para la terminación del conflicto, entre el gobierno nacional y las FARC-EP, cumple con los requisitos del derecho internacional para garantizar que los superiores militares responderán por su accionar durante el conflicto

This essay aims to develop the concept of responsibility of commanders in Colombian law, the way how it has been applied by national and international judges, as well by the international law.
Hence, the responsibility of commanders has been taken as one of the fundamental elements of any transitional justice process, precisely because the need to establish how will be the judgement of those responsible of crimes against humanity during the intern conflict.
Furthermore, the text includes an approach of the law development use for applying the final agreement for the conflict termination, between the Colombian government and the FARC-EP guerrilla.
It’s also important check if the mechanism used to judge, included in the agreement, is according with the international law related with commander’s responsibility
