    Los decretos autónomos son, aquellos actos de la administración, que se dictan en ejercicio de facultades atribuidas directamente por la Constitución, sin sujeción a ley previa. El conflicto sobre su naturaleza jurídica radica en que, al ser estos decretos considerados de contenido legislativo, no resulta ser muy claro si realmente lo son, cuando su control de constitucionalidad está sometido al Consejo de Estado y no a la Corte Constitucional, y cuando éste se hace por medio de acción de nulidad por inconstitucionalidad y no por nulidad simple. De esta forma, se concreta el conflicto sobre su naturaleza jurídica, si al ser un acto expedido por la suprema autoridad administrativa, es o no es un acto administrativo, y si de no serlo, resulte ser un acto de naturaleza ambigua

    The autonomous decrees are those that are dictated in exercise of powers attributed directly by the Constitution, without subordination to previous law. The conflict on its juridical nature takes place in the consideration of these decrees as decrees of legislative content. Although, this consideration is not so clear when we analyze its control of constitutionality, which is submitted to the State Council instead of the Constitutional Court. In the same way, it is important to consider that its control, it’s done by the action of nullity by unconstitutionality instead of the action of simple nullity.

    This is the basis of the concrete conflict on the juridical nature, in which, it important to clarify if, as an act sent by the supreme administrative authority, it is or it isn’t an administrative act, and if it isn’t, if it turns out to be an act of ambiguous nature
