El presente artículo es el resultado de una investigación académica, que realiza un análisis del acuerdo en materia de justicia alcanzado durante las Negociaciones de Paz en La Habana entre el Gobierno colombiano y la guerrilla de las FARC a la luz de la jurisprudencia de la Corte Interamericana de Derechos Humanos (CorteIDH), en dos sentidos: hacia la prohibición de la impunidad, y en relación con los estándares internacionales de justicia transicional. Ello se realizará mediante el estudio de líneas jurisprudenciales y del análisis del discurso sobre la obligación de juzgamiento de las sentencias de la CorteIDH. Se utilizará la hermenéutica para abordar el Acuerdo frente al derecho a la justicia.
This article is the result of an academic research, which analyses the justice agreement reached by the Colombian Government and the guerrilla of the FARC, in contrast to the jurisprudence of the Inter American Court of Human Rights (IACourtHR), in two aspects: towards the prohibition of impunity, and with regard to the international standards of transitional justice. This will be carried out through the determination of the case-law regarding the obligation of punishment in the sentences of the IACourtHR, along with the analysis of the discourse within the position adopted by that Tribunal. Finally, we will use the hermeneutics in order to compare the obligations arising from the right to justice according to the IACourtHR
