Resumen de La industria farmacéutica y su particularidad en la delimitación del mercado relevante

La adecuada delimitación del mercado relevante es el pilar fundamental del Derecho de la Competencia, pues su ineficiente delimitación acarrea consecuencias perjudiciales y, lejos de proteger la libre competencia, la pone en riesgo. Si bien existen varios parámetros que se emplean a nivel internacional para delimitar el mercado relevante, la industria farmacéutica presenta algunas particularidades que exigen un estudio diferenciado. Es por ello que resulta de vital importancia que las autoridades competentes para sancionar las conductas anticompetitivas tomen dichas circunstancias en consideración. De lo contrario, se impondrían sanciones que carezcan de sustento y que desincentiven la inversión en esta rama de la industria. En este sentido, este trabajo tiene como objetivo analizar los elementos que diferencian a la industria farmacéutica de otras industrias y que ponen de manifiesto la necesidad de abordar desde otra perspectiva la sustituibilidad entre medicamentos y la delimitación del mercado relevante.

A proper delimitation of relevant market is fundamental in the Antitrust Law, since it is the antecedent to any analysis that is attempted in this area of Law. In fact an inefficient delimitation entails harmful consequences and instead of protecting free competition, this improper delimitation would put it on risk.
The pharmaceutical industry has various characteristics that require that the study of relevant market is treated from different perspective than the ones that are took to analyze other kind of industries. This paper aims to analyze the elements that differentiate the pharmaceutical industry from other industries in order to demonstrate the need that the delimitation of the relevant market responds to the particularities of the pharmaceutical industry. Besides, it would reflect the need for the competent authorities to take into account all these features before establishing any sanction. Otherwise we would never ensure a proper and effective implementation of Antitrust Law.
