    La necesidad de asumir este estudio se debe a la inexistencia de los presupuestos teóricos que sirven de base para la concepción y regulación de la Seguridad y Salud en el Trabajo en el sector de trabajo por cuenta propia en el ordenamiento jurídico cubano, lo que incide en el papel protector del Derecho Laboral acorde con los cambios económicos y sociales del país. Para el logro de tal pretensión se parte de una sistematización de los criterios doctrinales, históricos y de Derecho Comparado de la Seguridad y Salud en el Trabajo, en especial del sector del trabajo por cuenta propia como base para su concepción y regulación en el ordenamiento jurídico laboral cubano así como del diagnóstico de las insuficiencias que presentan en el sector del trabajo por cuenta propia en los municipios Bayamo y Jiguaní, para su concepción y regulación en el código laboral cubano.

    The necessity to assume this study is due self-employed to the nonexistence of the theoretical budgets that you/they serve as base for the conception and regulation of the Security and Health in the Work in the work sector in the Cuban juridical classification, what impacts in the protective paper of the Right Labor chord with the economic and social changes of the country.For the achievement of such a pretense he/she leaves of a systematizing of the doctrinal, historical approaches and of Compared Right of the Security and Health in the Work, especially of the sector of the work self-employed like base for their conception and regulation in the Cuban labor juridical classification as well as of the diagnosis of the inadequacies that you/they present self-employed in the sector of the work in the municipalities Bayamo and Jiguaní, for their conception and regulation in the code of cuban work.
