Concepções materialista e idealista sobre os direitos humanos: da origem à Agenda 2030

    Tendo como ponto de partida a ideia de que o direito é parte da superestrutura da sociedade e, principalmente, que é criado a partir e nas relações sociais, busca-se, neste artigo, a partir da distinção entre os pensamentos de Marx e Hegel, materialista e idealista, respectivamente, formular uma teoria de como os dois autores e, consequentemente, as duas linhas teóricas deles derivada, compreendem o fenômeno do direito e, mais especificamente, dos diretos humanos. Este percurso nos levará a identificar e a distinguir entre duas correntes de pensamento jurídico, sobre o direito: o jusnaturalismo e o realismo, além de discutir as implicações da utilização dessas concepções pelos grupos sociais e acadêmicos em nosso tempo. Feito isto, analisamos, a partir dos ODS (Agenda 2030) como estes diferentes discursos são utilizados de forma concreta na atualidade e como as diferentes perspectivas teóricas determinam o olhar e o agir ao tratar dos direitos humanos.

    Starting from the idea that law is part of the society superstructure and, in particular, to ensure that it is built from the social relations, we seek in this article, starting from the distinction between the thoughts of Marx and Hegel, the materialist, and idealist, respectively, to formulate a theory as to how the two co-authors, and, as a result, the two derivated lines of theoretical thinking, comprehend law as phenomenon, and, more specifically, the human rights. This path will lead us to identify and distinguish between two currents of legal thought, on the law: jusnaturalism and realism, and to discuss the implications of the use of these conceptions by social and academic groups in our time. We analyzed, from the ODS (Agenda 2030) how these different argumentations are used in a concrete way today and how the different theoretical perspectives determine the look and action when dealing with human rights.
