  Este artículo presenta en líneas generales, la Teoría de la Argumentación Jurídica desarrollada por Robert Alexy en perspectiva a los entendimientos por el Supremo Tribunal Federal sobre el Art. 93, IX de la Constitución Federal. Así, se ha realizado una breve exposición del contenido de la obra y análisis de algunos entendimientos manifiestos por el Supremo Tribunal Federal acerca del Art. 93, IX. Mayor énfasis es dado a los caracteres atribuidos al discurso jurídico por Robert Alexy, y a la identificación de esos caracteres en la jurisprudencia del Supremo Tribunal Federal

  O presente trabalho apresenta, em linhas gerais, a Teoria da Argumentação Jurídica desenvolvida por Robert Alexy em perspectiva aos entendimentos manifestos pelo Supremo Tribunal Federal sobre o Art. 93, IX da Constituição Federal. Para tanto, é realizado uma breve exposição do conteúdo da obra e a análise de alguns entendimentos manifestos pelo Supremo Tribunal Federal acerca do Art. 93, IX. Maior ênfase é dada aos caracteres atribuídos ao discurso jurídico por Robert Alexy e à identificação desses caracteres na jurisprudência do Supremo Tribunal Federal

  This article presents, in general lines, the Theory of Legal Argumentation developed by Robert Alexy under the perspective of the understandings manifested by the Federal Supreme Court in Article 93, IX of the Brazilian Federal Constitution. Therefore, a brief presentation is provided on the content of the work and the analysis of some understandings manifested by the Brazilian Federal Supreme Court in Art. 93, IX. Greater emphasis is given to the characteristics attributed to the legal discourse by Robert Alexy and the identification of these characters in the jurisprudence of the Federal Supreme Court.
