    La sentencia dictada por la Sala de lo Social del Tribunal Superior de Justicia de Andalucía permite examinar la cuestión sobre la movilidad del personal laboral en las Administraciones Públicas, en concreto en el Instituto Municipal de Deportes del Ayuntamiento de Sevilla. En virtud de los hechos probados la Sala de lo Social considera que el empleador ha actuado dentro de los límites establecidos por los artículos 39 ET y 83 EBEP. Sin embargo, como podrá observarse, la regulación acerca de la movilidad del personal laboral no resulta baladí, jugando la negociación colectiva un papel de suma importancia.

    The pronouncement of the Social Chamber of the Superior Court of Andalucía opens the possibility of studying working mobility amongst the employees of the State Administration. In order to study this issue, we will analyze the Local Sports Institute of the Hall of Sevilla. According to the evidences shown in the Social Chamber, the employer is considered to have acted within the limits established in the articles 39 of the Workers Regulation and 38 of the State Workers Basic Regulations. Nevertheless, Working Mobility in the State Administration might become a difficult task, thus, the Workers Regulations will have to play a decisive role in this matter.
