Resumen de Reclutamiento ilícito y el nuevo modelo de justicia transicional en Colombia

El reclutamiento ilegal de niños, niñas y adolescentes (NNA) es una amenaza de guerra presentado en diferentes conflictos armados a lo largo del mundo, incluido Colombia. Así, existe un amplio marco normativo nacional e internacional, que proscribe dicho fenómeno con el objetivo de respaldar los derechos de los NNA. En Colombia, especialmente en un escenario de post-conflicto, es indispensable que la investigación, juzgamiento y penalización de este crimen sea acorde a las normativas nacionales e internacionales que existen en el área. El presente artículo mostrará cómo hasta el momento, con el Sistema Integral de Verdad, Justicia, Reparación y No Repetición (SIVJRNR) se ha buscado seguir dichos estándares, con la implementación del modelo de justicia transicional creado para tal fin.

The illegal recruitment of children and adolescents (CA) is a war crime that occurs in different armed conflicts throughout the world, including Colombia. Thus, there is a broad national and international regulatory framework, which proscribes this phenomenon in order to support the rights of CA. In Colombia, especially in a post-conflict scenario, it is essential that the investigation, prosecution and criminalization of this crime be in accordance with the national and international regulations that exist in the area. Thus, this paper will show how, up to now, the Integral System of Truth, Justice, Reparation and Non-Repetition (SIVJRNR) has sought to follow these regulations, with the implementation of the transitional justice model created for that purpose.
