En el presente estudio se analiza la evolución última de la jurisprudencia española en materia arbitral, muy particularmente en materia de extensión del convenio arbitral a terceros y de cláusulas arbitrales patológicas y, especialmente, cuando este último prevé, indistintamente, la sumisión a arbitraje y a los tribunales de la jurisdicción estatal.
