El artículo tiene como objetivo investigar el tema del walayat (tutela) del padre sobre el matrimonio de la hija virgen madura mediante métodos de investigación cuantitativa, como revisar las opiniones históricas y jurisprudenciales de los juristas de Imamiya y Sunni. Como resultado, a pesar del consenso sobre el walayat del padre o el abuelo paterno de la virgen menor, existen opiniones contradictorias sobre el walayat del padre o el abuelo paterno de la virgen madura. Como conclusión, la ley civil ha considerado necesario obtener el permiso de wali debido a cuestiones de seguridad social y la protección de los derechos de las niñas en la sociedad

The article aims to investigate the issue of father’s walayat (guardianship) on the marriage of the virgin mature daughter by quantitative research methods like reviewing the jurisprudential and historical views of Imamiya and Sunni jurists. As a result, despite the consensus on the walayat of the father or paternal grandfather on the minor virgin, there are contradictory views on the walayat of the father or paternal grandfather on mature virgin. As a conclusion, the civil law has deemed it necessary to obtain wali’s permission due to social security issues and the protection of the rights of girls in the society.
