  España ha ratificado la Carta Social Europea originaria y el Protocolo de 1988, pero no ha ratificado la Carta Social Europea revisada, ni el Protocolo de 1995. Nuestros Tribunales mantienen un interesante debate entre aquellos que consideran sus disposiciones not self-executing y aquellos que defienden que sí lo son. Esta investigación profundiza en las razones para no poder considerar invocables a día de hoy directamente ante los tribunales internos los derechos, que reconoce y garantiza la Carta Social Europea revisada.

  Spain has ratified the initial European Social Charter and the additional Protocol of 1988; but has not ratified neither the European Social Charter revised, nor the additional Protocol of 1995. Our Courts hold an interesting debate on whether the European Social Charter is or not self-executing. This research deals with the reasons not to invoke in spanish Courts rights recognized and guaranteed by the European Social Charter (Revised).
